1. Acceptance of Terms

By creating an account, accessing, or using the TechMalak platform ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you disagree with any part of these terms, you must not access or use the Service.

You must be at least 18 years of age to use the Service. By using TechMalak, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

2. Description of Service

TechMalak is a Trading Journal and AI-Powered Trade Intelligence Platform designed for:

• Logging and organizing cryptocurrency trade history via exchange API connections or manual entry.
• Providing AI-generated behavioral and psychological analysis of trading patterns.
• Displaying market data, news intelligence, and portfolio aggregation.
• Gamified engagement features including experience points, levels, and trader archetypes.

The Service is provided strictly for educational, self-reflection, and analytical purposes. TechMalak does not execute trades, manage funds, provide financial advice, or act as a custodian of any digital assets.

3. Educational Purpose & No Financial Advice

TechMalak is not a registered broker-dealer, investment advisor, financial planner, or financial institution in any jurisdiction. Absolutely none of the content provided by the Service constitutes financial, investment, legal, tax, or trading advice, nor is it a recommendation or solicitation to buy, sell, hold, or trade any financial instrument, digital asset, or cryptocurrency.

Any trading decisions you make are entirely your own. TechMalak provides tools for self-analysis — what you do with that analysis is solely your responsibility.

4. Educational Content & Blog

The TechMalak blog and other educational materials we publish are for information and education only. They are not financial, investment, tax, or legal advice, and they are not recommendations to buy, sell, or hold any asset.

Trading cryptocurrency involves substantial risk, including the possible loss of everything you put in; past performance — ours or anyone's — never guarantees future results. Any trades you make are your own decisions and your own responsibility.

Where our articles describe features of the TechMalak platform, they describe the product as it exists at the time of writing.

5. Assumption of Risk & Full Disclaimer of Liability for Financial Loss

By using TechMalak, you expressly acknowledge and agree that:

• Past performance, win rates, behavioral statistics, and trading metrics displayed on TechMalak are not indicative of future results.
• AI-generated insights, coaching nudges, and behavioral assessments are automated analytical outputs, not professional financial guidance.
• Market data displayed on the platform may be delayed, incomplete, or inaccurate due to third-party data provider limitations.
• You assume all risks associated with cryptocurrency trading and waive any right to hold TechMalak liable for financial losses of any kind.
• You will not rely on any information provided by TechMalak as the sole basis for any financial or investment decision.

6. User Accounts & API Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to notify us immediately at info@techmalak.com if you suspect unauthorized access.

Exchange API credentials are encrypted at rest using AES-256-GCM encryption. Despite these measures, you acknowledge that no security system is impenetrable and you connect your exchange accounts at your own risk.

7. AI-Generated Content Disclaimer

TechMalak uses artificial intelligence models from third-party AI companies (such as Anthropic, OpenAI, Google, and others) to power features such as AI chat, behavioral analysis, news sentiment scoring, trade auditing, and coaching nudges. The specific providers we use may change over time.

You acknowledge and agree that:

• AI-generated content may be inaccurate, incomplete, misleading, or entirely wrong. AI models can produce outputs that appear confident but are factually incorrect ("hallucinations").
• Behavioral assessments, trader archetype classifications, trait progression metrics, and psychological profiles are automated analytical outputs — not clinical diagnoses or professional psychological evaluations.
• AI-generated news sentiment and market analysis should never be used as the basis for trading decisions.
• TechMalak does not guarantee the accuracy, reliability, or completeness of any AI-generated content.
• Your chat messages, trading context, and psychological profile data are processed by third-party AI providers as described in our Privacy Policy.

8. Data Ownership & User Content

You retain full ownership of your raw account data, trade history, journal entries, and any content you create on the platform. By using TechMalak, you grant us a limited, non-exclusive license to process, display, and analyze your data solely for the purpose of providing the Service to you.

TechMalak may aggregate and anonymize user data to generate platform-wide analytics and behavioral models. This aggregated data is stripped of all personally identifiable information and cannot be traced back to any individual user. We will never sell your individual, identifiable trading data or use it to front-run trades.

9. Data Export & Account Deletion

You may download a complete copy of your data at any time from your Account Settings. The export is generated on our servers in JSON format and includes your profile, trades, positions, connected wallets, behavioral assessments, chat history, gamification progress, and associated records. Platform secrets (exchange API keys and wallet signatures) are redacted for your security, and purely operational or security records that are not your personal data are not included; the file documents what it excludes. The export either completes in full or fails visibly — you are never handed a partial file presented as complete.

You may request deletion of your account from your Account Settings. Deletion of your identifying information is irreversible — once confirmed, we permanently destroy all data that identifies you personally (profile, trades, exchange connections, chat history, behavioral assessments). We retain a separate anonymized summary of platform usage that cannot be linked back to you by any reasonable means, for our internal business records, as described in our Privacy Policy. We strongly recommend downloading your data before requesting deletion. Limited security audit logs are retained for fraud detection and incident investigation, as described in our Privacy Policy.

You can control or disable behavioral analysis at any time from your Settings; see our Privacy Policy for details.

10. Third-Party Services & Dependencies

The Service relies on third-party providers for core functionality, including but not limited to:

• Cryptocurrency Exchanges (Coinbase, Bybit, KuCoin, Bitget, Kraken) for trade data and portfolio balances.
• AI Model Providers — third-party AI companies (such as Anthropic, OpenAI, Google, and others) for chat, analysis, and behavioral features.
• Market Data Providers for cryptocurrency pricing and market information.
• Infrastructure Providers for hosting, database, and authentication services.

TechMalak is not responsible for the availability, accuracy, or performance of any third-party service. Changes to third-party APIs, rate limits, outages, or discontinuations may affect the functionality of the Service without notice. We make no guarantees regarding the continued availability of any specific integration.

11. Exchange Data Accuracy

Trade data, portfolio balances, and market information imported from third-party exchanges and data providers may be delayed, incomplete, or inaccurate. TechMalak does not independently verify the accuracy of data received from exchanges or market data APIs. You should always verify your positions and balances directly on your exchange platform.

Performance metrics, PnL calculations, and statistics generated by TechMalak are based on the data available and may not reflect your actual trading results with complete accuracy.

12. Gamification Features

TechMalak includes gamification elements such as experience points (XP), levels, trader archetypes, RPG-style stats, achievements, and training modules. These features are designed for engagement and self-improvement motivation only. Gamification elements have no real-world monetary value and cannot be exchanged, transferred, sold, or redeemed for cash, cryptocurrency, or any other form of compensation.

13. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Service or its behavioral algorithms.
• Use automated tools, bots, or scripts to scrape, crawl, or extract data from the platform.
• Share, sell, or transfer your account credentials or API keys to any third party.
• Create multiple accounts for the purpose of abusing platform features or gamification systems.
• Attempt to exploit, manipulate, or circumvent any security measures, rate limits, or access controls.
• Use the Service for any illegal activity, including money laundering, fraud, or market manipulation.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Upload malicious code, viruses, or any content designed to disrupt the Service.

Violation of these rules may result in immediate account suspension or termination at our sole discretion.

14. Intellectual Property

The TechMalak name, logo, brand identity, user interface designs, behavioral algorithms, AI coaching systems, and all associated intellectual property are owned by TechMalak and protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Service without express written permission.

15. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or harmful activity, or pose a risk to other users or the integrity of the platform.

You may terminate your account at any time by using the account deletion feature in your Settings. Upon termination, your right to use the Service ceases immediately.

16. Limitation of Liability

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. TechMalak makes no guarantee that the application will be uninterrupted, secure, or error-free.

To the maximum extent permitted by applicable law, in no event shall TechMalak, its founders, officers, employees, affiliates, agents, or licensors be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages, including but not limited to:

• Financial trading losses or missed trading opportunities.
• Loss of profits, revenue, data, or business opportunities.
• Damages resulting from AI-generated content, behavioral assessments, or analytical outputs.
• Damages resulting from unauthorized access to your account or exchange connections.
• Damages resulting from third-party service outages, data inaccuracies, or API failures.
• Data corruption, software bugs, or platform unavailability.

This limitation applies regardless of the theory of liability, whether in contract, tort, negligence, strict liability, or otherwise, even if TechMalak has been advised of the possibility of such damages.

17. Indemnification

You agree to indemnify, defend, and hold harmless TechMalak, its founders, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service or any trading decisions made while using the platform.
• Your violation of these Terms of Service.
• Your violation of any applicable law or regulation.
• Any content you submit, post, or transmit through the Service.
• Your improper configuration of exchange API key permissions.

18. Service Availability

TechMalak does not guarantee any specific level of uptime, availability, or performance. We may modify, suspend, or discontinue any part of the Service at any time without prior notice. Scheduled maintenance, updates, or unforeseen technical issues may result in temporary service interruptions. We will make reasonable efforts to minimize disruptions but are not obligated to provide advance notice.

19. Modifications to Terms

We reserve the right to update or modify these Terms of Service at any time. When we make material changes, we will notify you via email or through a prominent notice within the platform at least 30 days before the changes take effect. Your continued use of TechMalak after the effective date constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and may delete your account.

20. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be resolved in the courts of the Province of Ontario, Canada, and you consent to the exclusive jurisdiction of those courts, unless otherwise required by applicable law.

21. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

22. Entire Agreement

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and TechMalak regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
